Terms and Rules

Please read these Terms and Rules ("Terms, "Agreement") carefully before using the upsetbabygames.com website ("Service", "Site") operated by Upset Baby Games ("we", "our", "us", "Team").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others (the "Users") who access or use the Service. If you do not agree with any portion of the Terms then you must cease all further access to our Site.
User Interaction
Keep it friendly. When playing online games and/or communicating with other Users or the Team please be aware you are interacting with a community comprised of different age groups, heritages, races, social levels and educational backgrounds. There should be no abusive language, personal attacks, threats, or any other unkind behavior.
You may not post any offensive content on the Site including your user name, posts, or any online messages, public or private, in-game or otherwise. The following behavior is strictly forbidden and can result in your account being limited or closed altogether: cheating, using offensive/vulgar language, making personal attacks, spamming or advertising, religious or political debate, intentionally pointless/distracting comments, disclosing other's personal data without consent, attemp to solicit account information from other Users, and discussion of illegal activities.
No Cheating
Any form of unsportsmanlike behavior will not be tolerated. We reserve the right to reset your scores and/or ban your nickname and/or email for this offense. It includes artificially adjusting your rating, encouraging your opponent to leave the match, intentionally losing, accepting your opponent's behavior who is intentionally losing, using the other's account, or using more than one nickname.
Only One Account
Users may only have ONE upsetbabygames.com account, unless explicitly allowed to have more. Members who create more than one account may have all accounts closed.
Registration
Membership grants you the ability to participate in setting online high-scores, chat during online matches, unlock extra in-game goodies, and make purchases from our store. When you accept this Agreement and complete our registration process, you agree to all of the Terms and our Privacy Policy.
You are solely responsible for all activity on your account and for the security of your computer system. It is important that you do not reveal your password to other users. You agree not to reveal your password to other users. Your account is at risk if you let someone use it inappropriately and your membership is subject to termination if you or anyone using your account violates our Terms. We reserve the right to restrict access for Users who provide unreal data or register multiple accounts.
Downloadable Purchases
We only guarantee to provide access to a downloadable copy of the User's purchase for 1 recorded download or a minimum of 30 days after the initial purchase date, whichever occurs first, after which it is the User's responsibility to backup their own purchases. We will continue providing access to these purchases past the 30 day period only on a 'best effort' basis which can be terminated at any time for any reason.
Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Refunds will NOT be given to Users who are banned from this site due to violating the Terms. Users who have their accounts terminated without having breached the Terms, such as in the case of Site closure, will be refunded, to the best of our ability, any purchases made within 30 days of termination in any one of our actively accepted cryptocurrencies.
If a User's account is terminated for breach of Terms while products remain undownloaded in the User's account then we will attempt to send an e-mail to the User using the e-mail on record. This e-mail will contain auto-generated links to each of their undownloaded purchases that will permit up to 3 downloads each.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Warranty
The use of Services and any software obtained through the use of Services ("Software") are at the sole risk by you. Our Services and Software shall be provided on an "as is" and/or "as available" basis. We expressly disclaim any and all warranties of any kind whether expressed or implied.
Limitation of Liability
You explicitly acknowledge, understand and agree that we shall not be liable to you for any punitive, indirect, incidental, special, consequential, or exemplary damages that may occur and result from:
- The use or inability to use our Service;
- The use or inability to use our Software;
- unauthorized access to or the alteration of your transmissions and/or data through hacking or any other means;
- statements or conduct of any such third party on our Service;
- and any other matter which may be related to our Service.
In the event you have a dispute, you agree to release Upset Baby Games (and its officers, directors, employees, agents, affiliates, partners, and any other third parties) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way connected to such dispute.
Anti-Hacking Policy
By establishing an account on upsetbabygames.com, you agree that we are not responsible for any damage, loss, or injury resulting from, hacking, tampering, or other unauthorized access to upsetbabygames.com or your account.
Any attempt to gain unauthorized access to our system or any account, interfere with procedures or performance of the Site, or deliberately damage or undermine Upset Baby Games is subject to civil and/or criminal prosecution and will result in immediate termination of your account.
You must not reverse-engineer, decompile or modify any Upset Baby Games's client software in any way. You must not use a modified/customized version of the client software or attempt to sub-license it. You must not create or provide any other means by which an Upset Baby Games game or piece of software may be accessed by others.
